What happens.......?

When a person is convicted of a crime and the victim has not had ual and has contracted genital and the accused is sitting in jail for this crime. The accused asked his public defender to test him as he knew he did not have it or the cold sore type. She refused to test him and it went to trial and was found guilty. Now the test was done 4 weeks after the trial and he does not have either of the types of and he is going for sentencing in 4 days. The attorney said she sent out some juror questionaires to have the jury in this trial fill out and send back. I guess the attorney said that she has a few come back stating if there was eveidnece stating he did not have they would have found him not guilty by reasonable doubt. Now what will the sentencing judge likely do now at sentencing? My sister is very worried and nervous over this whole thing and she is standing beside her husband. This was to have happened 13-14 yrs ago and just now coming out.
